General terms and conditions

1. Scope

These terms apply to all orders placed with importsupport.ch, Dionisis Frezados, Zurich (“we”), in particular customs clearance, registration and transport of vehicles into Switzerland. Anything different applies only if it is written in the quote.

2. Quote and contract

Our quotes are valid until the date they state. The contract is concluded when you accept the quote online, by email or in writing. What counts are the services and prices in the accepted quote and these terms in the version in force at acceptance.

The calculations on our website are non-binding estimates. Only the accepted quote is binding.

3. Our services

We carry out the services listed in the quote with care and to the best of our knowledge (a mandate under Art. 394 et seq. of the Swiss Code of Obligations, OR). We do not guarantee a particular result, such as passing the vehicle inspection (MFK) or a particular purchase price.

If we negotiate with a seller for you, you conclude the purchase contract yourself. The seller, not us, is responsible for the vehicle’s defects, condition, history and description.

4. Customs clearance and official costs

For customs clearance we act as your representative towards the Federal Office for Customs and Border Security (BAZG). You remain the importer and owe the duties and taxes.

Official costs such as automobile tax, import VAT, the CO2 penalty and cantonal fees are not included in our price. You pay them directly to the authority concerned. The amounts in the quote are estimates; what counts is the BAZG assessment, the Swiss Federal Office of Energy’s decision and the road traffic office’s invoice.

5. Transport

Transport is carried out by a carefully selected transport partner. Liability for loss and damage in transit is governed by the statutory rules on contracts of carriage and, for cross-border road transport, by the Convention on the Contract for the International Carriage of Goods by Road (CMR).

Please check the vehicle on handover and note any visible damage on the handover report straight away.

6. Your cooperation

You provide complete and truthful information and documents in good time, in particular the purchase contract or invoice, the registration document, the certificate of conformity (CoC), proof for personal belongings and a Swiss insurance certificate. You bear the consequences of incorrect or missing information, such as back payments or fines imposed by the authorities.

7. Prices and payment

Our prices are fixed prices in Swiss francs. We are not registered for VAT, so no VAT is added. Extra work not listed in the quote is charged only with your consent.

We invoice once the vehicle has been delivered and registered. The invoice is payable within 10 days. After that you are in default without a reminder and owe default interest of 5 % a year (Art. 104 OR).

8. Dates

Dates we give are estimates. We are not responsible for delays caused by authorities, sellers, border waiting times, weather or other circumstances beyond our control.

9. Withdrawal

You can withdraw from the order at any time (Art. 404 OR). We charge pro rata for services already provided and costs already incurred, such as a booked transport. If you withdraw at an inopportune time, compensation for the resulting damage is reserved.

10. Liability

We are liable for damage we cause intentionally or through gross negligence. For slight negligence our liability is limited, as far as the law permits, to the price of the order concerned. As far as the law permits, we are not liable for decisions of authorities, for partner services under section 11 or for indirect damage such as loss of profit.

11. Partner services

We refer insurance, leasing, financing, servicing and repairs to partners. The contract is concluded directly between you and the partner, on the partner’s terms. Lending is prohibited if it leads to over-indebtedness (Art. 3 of the Swiss Unfair Competition Act).

12. Data protection

We process your personal data in line with our privacy policy on importsupport.ch.

13. Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is Zurich. Mandatory places of jurisdiction are reserved, in particular for consumers at their place of residence (Art. 32 of the Swiss Civil Procedure Code).

14. Language versions

These terms are available in German, English, French, Italian and Greek. The German version is binding.
